PostHeaderIcon Republic Act 10666 : Children’s Safety on Motorcycles Act

Small children will not be allowed anymore to ride motorcycles as Republic Act 10666 or known as the Children’s Safety on Motorcycles Act an Act providing safety of children aboard motorcycles will take effect on Friday, May 19, 2017. This follows the implementation of the Anti-Distracted Driving Act tomorrow.

Section 4 of RA 10666 states that:

“It shall be unlawful for any person to drive a two (2)-wheeled motorcycle with a child on board on public roads where there is heavy volume of vehicles, there is a high density of fast moving vehicles or where a speed limit of more than 60/kph is imposed.”

However, it is legal if the child:

(a) …can comfortably reach his/her feet on the standard foot peg of the motorcycle;
(b) …can reach around and grasp the waist of the motorcycle rider; and
(c) …is wearing a standard protective helmet referred to under Republic Act No. 10054, otherwise known the “Motorcycle Helmet Act of 2009.

Meaning, all three must be met. Penalties range from P3,000 to automatic revocation of driver’s license.

The law was pursued in light of numerous motorcycle accidents which resulted to injuries and/or fatalities involving children.
